He spent his youthful days on his father's farm, assisting his parents and spending his spare time in attending the district school, both public and select. He finally secured a classical and scientific education in Allegheny College, at Meadville, Pennsylvania. He entered as a student of law the office of Smith & Mitchell, at Butler, in June, 1854, and was admitted to the Butler bar in September, 1856. While pursuing the study of the law, Mr. Kirker taught school and followed surveying occasionally as a means of support. He was elected District Attorney for Butler County in the autumn of 1859, and filled that office for three years. He was commissioned Provost Marshal of the Twenty-third District of Pennsylvania, by President Lincoln, with the rank of Captain of Cavalry, on the 18th of April, 1863, and served as such until the 1st of October, 1865, when he was mustered out of service by reason of the close of the war. He was at once admitted to the Pittsburgh bar, where he then practiced successfully.

He attended the public schools of his native county and later earned money with which to attend Allegheny College. He then studied law and surveying at the same time. At the age of twenty-four years, on September 22, 1856, he was admitted to practice in the courts of Butler county, Pennsylvania. He was elected district attorney, and during the Civil war was appointed provost-marshal for the district comprised in Allegheny and Butler counties, Pennsylvania.
