He commanded the troops guarding Perry's fleet, when his ships were being built at Erie, Pennsylvania, during the War of 1812.

He served as a major in the regiment of Colonel Rees Hill, of the Pennsylvania Militia, during the War of 1812. His term of service extended from April 21 to November 8, 1813. We have a short sketch of his career from the pen of Mr. John C. Black, as follows "The battalion under the command of Major Byerly marched from Greensburg to Erie, thence to Cleveland, and from there to Sandusky and Portage river. From lack of camp equipage and the exposures naturally incident to the service, he contracted inflammatory rheumatism, from which his sufferings in after years were terrible, and which resulted in his death at Vermilion, Ashland county, Ohio, May 18, 1845. At the close of his service he returned to his father's residence at North Huntington township, Westmoreland county. In 1826, he was married to Mrs. Elizabeth Black, widow of James Black (her "maiden name was Elizabeth Skyles"). Soon after his marriage, he removed to Ashland County, Ohio. His wife survived him and applied for and received a pension for five years, under the act of February 3, 1853, from June 26, 1857, which was renewed to her for life, under the act of June 3, 1858. Benjamin Byerly, a brother of Major Byerly, who was a second lieutenant in the Nineteenth United States Infantry, during the War of 1812, made an affidavit in the claim. At the time of making the application in 1862, Mrs. Byerly was seventy-six years of age."
